The subjects that are to be dealt with by the government have been divided between the center and the state for effective functioning. This division of power was incorporated by the Constituent Assembly during the drafting of the Indian Constitution. It is this division of power that makes India a Federal Nation. The division of powers is discussed in the 7th Schedule of the Indian Constitution. It provides 3 lists namely; Union List, State List and Concurrent List.
The Union List contains subjects which are taken care of by the central government. These include issues which require a nationwide uniformity. They include Army, Defense, Communication, Railways etc.
The State List has subjects that are under the control of the State government. But in case of an emergency, the center can interfere and take action on any subject on the State List. They include subjects like Police, Public Healthcare, Sanitation etc.
The Concurrent List has subjects that both the Center and the State can legislate on these subjects. This concept of having a ‘concurrent list’ was inspired from the Constitution of Australia. This list has subjects like Education, Forest, Trade etc.
Finally, the Constitution also provides provision in Article 248, stating that ‘any subject that is not included in any of the above lists will be solely the responsibility of the Parliament. It means there are other subjects which came into existence many years after the Constitution was written. These were issues which could be accommodated in any of the list. Thus, these subjects are called miscellaneous or residuary subjects. The Parliament alone has the power to make any laws regarding these matters.
The three lists cover almost all the major subjects, thus the main reason for a residual list is to allow parliament to legislate on an issue which has escaped the critical observation of the house.
