There is no special procedure in the Constitution of India for the appointment of a Prime Minister. Article 75 merely specifies that India has a Prime Minister whose appointment is made by the President. The head of the Council of Ministers is the Prime Minister.

The President is the only de jure head, while the Prime Minister is said to be the de facto head who actually exercises the executive powers. The Prime Minister proposes that the names of his team members be assigned to the rank of Minister. Just such persons may be produced by the President as ministers whose names are suggested by the Prime Minister. The Prime Minister decides which department the minister will be given, and he may also adjust any minister's assigned department.

He also chairs the meeting of the Council of Ministers and may, according to his wishes, alter the decisions. He may order any minister to resign or in the event of conflicts of opinion, urge the President to fire him. He also monitors the actions of all ministers and directs them. He will by resigning from office, bring about the collapse of the Council of Ministers.

Note: When the Prime Minister resigns or dies, all ministers are unable to hold positions anymore, which means that with the death/resignation of the Prime Minister, the Council of Ministers dissolves itself.
