During this emergency period elections were suspended and council liberties were curbed. Press was censored and many opponents of Gandhi were also arrested. The emergency marked the violation of the sundry of human rights. In 1971, Indira Gandhi won the election and was hailed as an iron lady across the country, but after a few years of ruling she faced criticism and was alleged of bribing voters, and a petition was filed against her in Allahabad high court.

Allahabad High court found her guilty and judgment was passed against her. After the Judgement, she called an emergency meeting and then appealed to the Supreme court. The Supreme court put a complete stay on Allahabad high court judgment and allowed Indira Gandhi to remain the prime minister. After this decision, protests and demonstrations started against congress, and to suppress this uprising Indira Gandhi advised the then President Fakhruddin Ali Ahmad to declare an emergency across the country.
