The National Commission for Backward Classes of India is a constitutional body established on 14 August 1993 under India's Ministry of Social Justice and Empowerment (123rd constitutional amendment bill 2017 and 102nd constitutional amendment bill 2018 to make it a constitutional body) (Article 338B of the Indian Constitution). This Commission was formed as an initiative for investigating the conditions and difficulties of the socially and educationally backward classes and thus making appropriate recommendations.

According to Article 338B(5), it is the Commission's responsibility to—
- to investigate and monitor all things relevant to the safeguards provided for the socially and educationally backward classes by this Constitution or any other law currently in force or under any order of the Government, and to assess how well they are working.
- to look into particular complaints about the restriction of rights and protections for the socially and educationally disadvantaged.
- to take part in and advise on the socio-economic development of the socially and educationally disadvantaged classes, as well as to assess their progress under the Union and any State
- to report on the effectiveness of those safeguards to the President on an annual basis and at other times as the Commission sees suitable;
- to make recommendations in such reports as to the steps that the Union or any State should take to ensure that those safeguards and other measures for the protection, welfare, and socio-economic development of the socially and educationally disadvantaged are effectively implemented; and
- to perform any additional tasks related to the protection, welfare, development, and progress of the socially and educationally disadvantaged as the President may designate by rule, subject to the rules of any law passed by Parliament.

So, NCBC comes under Article 338B(5).

Note: The National Commission for Backward Classes did not have the authority to investigate the problems of people from Other Backward Classes at first. These powers have now been vested in NCBC as a result of the 102nd Constitutional Amendment Act and the introduction of Article 338B.
