The president is bound by the constitution . Actions which are non constitutional are not accepted by the President.Joint sitting can be summoned by the president in the following condition :
if a bill has been passed by one house and transmitted to the other house and the bill is rejected by another house
OR the amendments to be made in the Bill has been rejected by the house.
Or it has been more than six months from the date of the reception of the Bill by another house without the bill being passed by it. This calling of session is given in article 108. It is presided over by the speaker. If the speaker is absent then by deputy speaker of the Lok Sabha, Chairman of Rajya Sabha does not preside over the joint session at any cost.
Note: The president is bound by the constitution to act on a device of the prime minister and cabinet. The responsibility and authority to defend and protect the constitution of India is of President.
