The impeachment motion against the President can be moved for violating the Constitution of India by the Parliament. The impeachment charge shall be lodged by either House of Parliament. The resolution to impeach has to be passed by a 2/3rd majority of the total members of the originating house. The impeachment charge, preferred by any House of Parliament, the other House shall investigate all the charges or cause of the charge. The President has the right to appear and to be represented at such an investigation.
As a result of this investigation, if a resolution is passed and supported by not less than two-thirds of the total members of the House by which the charge was investigated or caused to be investigated, declaring that the charges preferred against the President are sustained, such resolution will result in the removal of the President from his office as from the date on which the resolution is passed.
According to Article 65 of the Indian Constitution, the Vice-President of India will have to discharge the duties if the President’s office falls vacant due to any reason other than the expiry of his term. A vice-president who discharges the functions of the President has all the powers and immunities of the president and is entitled to the same allowances as the President. During this period, the vice-president doesn’t function as the Chairperson of the Rajya Sabha
