The National Commission for Scheduled Castes is governed by Article 338 of the Indian Constitution. The National Commission for Scheduled Tribes is dealt with in Article 338 A.

Article 338 A states that the National Commission for the Scheduled Tribes will be established to represent the Scheduled Tribes. The Commission shall consist of a Chairperson, Vice-Chairperson, and three other Members, subject to the provisions of any legislation passed by Parliament in this regard, and the terms of service and tenure of office of the Chairperson, Vice-Chairperson, and other Members so named shall be as determined by the President following the rules. It shall be the Commission's responsibility to examine and control all matters relating to the protections given for the Scheduled

Tribes under this Constitution, any other legislation in effect at the time, or any order of the Government, and to assess how well they are performing; inquire into particular concerns about the Scheduled Tribes' lack of rights and safeguards; engage in and counsel on the Scheduled Tribes' socio-economic growth planning process and review the progress of their advancement under the Union and any State; to make recommendations in those reports as to the actions that the Union or any State should take to ensure the successful execution of such protections and other steps for the Scheduled Tribes' security, health, and socio-economic progress and to perform any other duties related to the security, health, progress, and advancement of the Scheduled Tribes that the President may specify by regulation, subject to the provisions of any law passed by Parliament.

- In 2004, the National Commission for Scheduled Tribes was formed as a separate Commission as a result of the Constitution Act, 2003, which amended Article 107 and added Article 338A. This was the 89th amendment.
